1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Advanced Learning Academy ("Company," "we," "us," or "our") regarding your use of the Real World IQ website and cognitive assessment services (collectively, the "Services").

By creating an account, making a purchase, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use our Services.

You must be at least 18 years old to use our Services. By using the Services, you represent that you are at least 18 years of age.

2. Description of Services

Real World IQ provides online cognitive assessment services, including:

• A 100-question cognitive assessment measuring performance across six brain regions
• Instant on-screen results upon completion
• A comprehensive PDF report delivered to your email
• Career recommendations based on cognitive profile (Professional tier)
• Speed bonus analysis and processing speed metrics
• IQ equivalency estimates across multiple traditional scales

3. Important Disclaimers

No Professional Advice

The results, scores, and recommendations provided by our Services are for informational and educational purposes only. They do not constitute professional, medical, psychological, or career counseling advice. Always consult qualified professionals for important decisions.

Assessment Limitations

Cognitive assessment results can be influenced by many factors, including but not limited to:

• Test-taking environment and conditions
• Physical and mental state at time of assessment
• Familiarity with test-taking formats
• Technical factors (device, internet connection)

Your results represent a snapshot of cognitive performance under specific conditions and should not be considered a definitive measure of intelligence or capability.

Career Recommendations

Career recommendations are generated algorithmically based on cognitive profile patterns. They are suggestions for exploration, not guarantees of career success or suitability. Employment decisions should be based on comprehensive evaluation of skills, experience, interests, and market conditions.

IQ Equivalency Estimates

IQ equivalency scores are statistical estimates based on performance correlations. They are not official scores from WAIS, Stanford-Binet, Mensa, or other testing organizations. For official IQ testing, consult licensed psychologists or recognized testing organizations.

4. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Payment and Refund Policy

Pricing

Current pricing is displayed on our website. All prices are in U.S. dollars. We reserve the right to change pricing at any time; changes will not affect completed purchases.

Payment Processing

Payments are processed securely through Stripe. By making a purchase, you authorize us to charge your selected payment method. We do not store your complete credit card information.

No Automatic Renewals

Our assessments are one-time purchases. There are no subscriptions or automatic renewals unless explicitly stated and separately agreed to.

6. Intellectual Property

All content, including but not limited to assessment questions, scoring algorithms, reports, graphics, text, and software, is the exclusive property of Advanced Learning Academy or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not:

• Copy, reproduce, or distribute assessment content
• Reverse engineer or attempt to extract our algorithms
• Use our content for competing products or services
• Remove or alter any proprietary notices
• Share your account or assessment access with others

Your Content

You retain ownership of information you provide. By using our Services, you grant us a license to use your anonymized and aggregated data to improve our assessment methodology and for research purposes.

7. User Conduct

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Use automated systems to access the Services without permission
• Impersonate another person or entity
• Share assessment questions or answers publicly
• Take the assessment on behalf of another person
• Use third-party assistance during the assessment

8. Limitation of Liability

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid for the Services in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Advanced Learning Academy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any decisions made based on assessment results

10. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:

• Your right to use the Services ceases immediately
• We may delete your account and data (subject to legal retention requirements)
• Provisions that by their nature should survive termination shall survive

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of law principles.

Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at legal@advancedlearning.academy to attempt to resolve the dispute informally.

Arbitration Agreement

Any dispute that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Indianapolis, Indiana, or remotely at your election.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Services.

12. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Advanced Learning Academy regarding the Services.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.

Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

Assignment

You may not assign these Terms without our written consent. We may assign our rights and obligations without restriction.

Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.
